Our mission is simple: Help motor carriers avoid nonpayment and recover the freight charges they have earned. Freight Broker 911 was developed by transportation recovery professionals with more than 20 years of specialized experience in the transportation industry, federal transportation law, and the recovery of unpaid freight charges. Our focus is exclusively on helping motor carriers recover freight charges that brokers, shippers, or other responsible parties have failed to pay. We understand the complexities of the transportation industry and the legal responsibilities of brokers, shippers, and consignees. Our expertise extends beyond traditional debt collection to include federal and state statutes, transportation regulations, established case law, and their practical application to freight payment disputes. We analyze bills of lading, broker-carrier agreements, contracts of carriage, freight payment obligations, assignments of freight charges, and relevant judicial decisions to identify parties who may be legally responsible for payment. Our experience allows us to look beyond the unpaid invoice, evaluate the legal obligations of the parties involved, and identify recovery options that traditional collection agencies may overlook. Do You Charge Only When You Collect? No. We work on a 100% contingency basis — we only get paid when you do. There are no upfront fees or expenses. Even if litigation becomes necessary, we cover all upfront costs, including attorney fees, court filing fees, and litigation expenses. If we don't recover your unpaid freight charges, you owe us nothing. If a Broker Doesn't Pay, Is the Shipper Liable? Paying the broker does not automatically mean the carrier has been paid or that the shipper or consignee has been legally released from liability. Each claim depends on the bill of lading, applicable contracts, statutory requirements, and the specific facts of the shipment. The United States Supreme Court has described the bill of lading as the basic transportation contract governing the relationship between the parties. See Southern Pacific Transportation Co. v. Commercial Metals Co., 456 U.S. 336 (1982). Federal courts have also specifically addressed situations in which a shipper paid a broker, freight forwarder, or other transportation intermediary, the intermediary failed to pay the carrier, and the shipper was nevertheless held responsible for the carrier’s unpaid freight charges. Applicable authority includes, but is not limited to, Strachan Shipping Co. v. Dresser Industries, Inc., 701 F.2d 483 (5th Cir. 1983); Oak Harbor Freight Lines, Inc. v. Sears, Roebuck & Co., 513 F.3d 949 (9th Cir. 2008); Central States Trucking Co. v. J.R. Simplot Co., 965 F.2d 431 (7th Cir. 1992); and Contship Containerlines, Inc. v. Howard Industries, Inc., 309 F.3d 910 (6th Cir. 2002). Consignee liability is not limited to case law. Congress specifically addressed liability for motor-carrier freight charges in 49 U.S.C. § 13706, “Liability for Payment of Rates.” The bottom line: Payment to a broker does not automatically discharge the underlying freight charges. Depending on the bill of lading, statutory requirements, contracts, and facts of the shipment, the shipper, consignee, beneficial owner, or other responsible party may still be liable to the unpaid motor carrier. When a broker fails to pay and the shipper or consignee will not voluntarily resolve the freight charges, that is where our experience matters. We know how to evaluate these claims, identify the responsible parties, and pursue payment through collection efforts and, when necessary, litigation. Can a Broker Offset Against My Freight Charges? One of the biggest problems we see is an abusive offset procedure where a broker acts as the accuser, decision-maker, and collector all at once. The broker claims a late delivery, cargo loss, customer chargeback, or other alleged damage, decides what it believes the carrier owes, and then simply deducts that amount from otherwise valid freight charges. In many cases, the carrier is given little or no meaningful opportunity to dispute the claim before its money is taken. A broker calling something a “claim” does not automatically establish that the carrier owes the money. Likewise, a unilateral deduction does not automatically make the underlying claim valid. The first question is whether the broker-carrier agreement actually gives the broker a contractual right of setoff. Even where an agreement permits offsets, there still must be a legitimate basis for the underlying claim and the amount withheld. For interstate transportation, claims involving cargo loss, damage, or certain damages caused by unreasonable delay may also fall under the federal Carmack Amendment, 49 U.S.C. § 14706. Carmack provides the federal framework governing a motor carrier’s liability for loss or damage to interstate shipments. The United States Supreme Court has also recognized that carrier liability can extend to damages resulting from a failure to transport freight with reasonable dispatch. See New York, Philadelphia & Norfolk Railroad Co. v. Peninsula Produce Exchange, 240 U.S. 34 (1916). But a late delivery does not automatically give a broker the right to select an amount and deduct it from the carrier’s freight charges. The underlying claim must still be legally supportable, and the party asserting the claim must be able to establish the loss, the carrier’s responsibility for it, and the amount of damages. Carriers should not assume that a broker’s deduction is final simply because the broker took the money. If a broker has withheld or offset your freight charges, we can evaluate the claim, challenge unsupported deductions, and pursue recovery of the money when appropriate. Do You Sue Shippers if the Broker Fails to Pay? Yes. When legally justified, we will pursue litigation against shippers, consignees, or other parties who may be responsible for unpaid freight charges. Federal transportation law, applicable statutes, and established case law may provide grounds for recovery against these parties, even when the broker has gone out of business or has already received payment. We prefer to resolve claims without litigation whenever possible. However, when necessary, we work with legal counsel to pursue recovery through the courts. There are no upfront costs to you, even if we file a lawsuit. We cover the upfront expenses, including attorney fees, court filing fees, and other litigation costs. How To Get Started?
